Campaign against a lazy fat-cat judge when elections come around to get him off of the bench?
I had a hearing where the judge actually nodded off for a moment, and after a few moments woke up with a start in front of the whole court room. In the end his ruling was not based on a preponderance of the evidence as it pertained to THAT hearing but was in fact a “judgment” about his opinion of the trial that had yet to be set. His ruling also damaged my case as it created a prejudice that tainted it through precedence. My attorney even acknowledged this but said, “He’s a judge, he can do that. It’s not right but do you want to spend time and money fighting it?”
This judge has no law degree, and has been on the bench for 16 years and I think is part of an “old boys network.” He doesn’t even live in our city but five towns (60 miles) away. When elections come up sometimes these judges run unopposed, or may have one challenger but an incumbent always wins. Bottom line, what I witnessed in my hearing was a judge who was falling asleep and not following the law. It seems to become very much an “Emperor with no clothes” situation, and sitting judges seem not only to be the law, but are above it. How does one address this? When elections come about how would one go about legitimately campaigning against a lazy, fat cat judge who plays loosey-goosey with the law? This judge’s poor job performance is a serious issue that affects the lives of the people who stand in judgment in front of him.
It’s not just my bitterness that a hearing “did not go my way”, even my lawyer was quite aware that this judge is not fair, and arbitrarily follows the rules. I do get very angered by abuse of power in any forum I must admit.
Editorials? Posters? TV ads? I mean he’s a judge, are we allowed to publicly point out his shortcomings and challenge his authority in a proper setting? I never see anything in the press or media that ever challenges a judge’s performance, credentials, or in any way puts them up to scrutiny.
This an excerpt from an article is the only thing I ever found in the press that indicated perhaps Odlin is unqualified. I’ve never seen a challenge from the citizenry. (Odlin is my concern)

ODLIN: I am not an attorney. However, I have 16 years of educated experience, which is continually approved by the state of Montana. I am required to go to mandatory schooling every six months and be tested by the state of Montana every fourth year, which has been successful.
REICHELT: While I do not feel I must “put out another’s light for mine to shine,” since the question calls for me to contrast myself from my opponent, my opponent has no legal training except the five-day orientation course required after being elected to office. This course is calculated to prepare him to pass the quiz required for confirmation to office. How does a private citizen get involved in a campaign to see that a judge not get elected again? What sort of publicity, and or strategy would one employ to show that a person in power is incompetent that is demonstrative, but legal?
